Article 1 (Purpose)
These Terms govern the use of the BOMTOLL online store (the “Store”) operated by Mobility Suksan Co.,LTD (the “Company”) and set out the rights and obligations of the Company and its users.
Article 2 (Definitions)
“Store” means the online marketplace established by the Company to sell electronic components and related goods. “User” means any member or guest using the Store. “Member” means a user with a registered account; membership is not limited by individual, sole-proprietor or corporate status. “Consumer Transaction” means a purchase for personal consumption that falls within the consumer protections of Korean e-commerce law. “Business-Purpose Transaction” means procurement for business, research, development, production, commercial activity or another non-personal-consumption purpose. “International Quote” means the pre-payment process through which the Company confirms availability, freight and transaction terms for a delivery address outside Korea.
Article 3 (Publication and Amendment)
The Company publishes these Terms and its legally required business details where users can readily find them. Amendments will be announced at least seven days before taking effect, or 30 days in advance for a material adverse change. Unless otherwise agreed, an amendment does not alter a contract already formed before its effective date.
Article 4 (Services)
The Company provides product information, purchasing, payment, delivery, quotation and customer support services. If a product becomes unavailable because of supplier stock or specification changes, the Company will notify the user and refund any amount already paid in accordance with applicable law. Services may be temporarily interrupted for maintenance, communications failures or events beyond reasonable control.
Article 5 (Accounts)
A user becomes a member when the Company accepts a registration submitted with agreement to these Terms and the Privacy Policy. Users under 14 may not register. Members must keep their information accurate and credentials secure and promptly report suspected misuse. The Company may reject or restrict an account for false information, identity misuse, interference with the Store or other legitimate cause.
Article 6 (Closing an Account)
A member may request account closure through the Store. An active order, refund or dispute must first be completed. Login access ends upon closure. The Company retains only records required for transactions, tax, dispute handling or other legal obligations and deletes them when the applicable retention period expires.
Article 7 (Placing an Order)
Before ordering, the user must review the product, quantity, shipping address, payment method and any cancellation or return restrictions. The user must provide accurate order and delivery information and may be responsible for reasonable additional costs caused by incorrect information.
Article 8 (Formation of Contract)
A sales contract is formed when the Company sends notice accepting the order. The Company may reject or cancel an order for an obvious pricing or stock error, supply failure, suspected payment fraud or missing order information, and will promptly refund any payment received. A receipt notice alone is not acceptance where a separate acceptance step is stated.
Article 9 (Price and Payment)
Orders delivered within Korea are displayed and paid in Korean won. The final product price, taxes, delivery charge and total appear at checkout. An order for delivery outside Korea does not proceed to online payment and instead becomes an International Quote. KRW amounts shown in the catalog are for reference; the quotation or invoice determines the actual currency, amount, freight and remittance method. Full card details are handled by the payment provider and are not stored by the Company. Domestic orders are paid by credit card or virtual account (bank deposit); where the single payment amount including VAT exceeds KRW 10,000,000, the order cannot be paid through the payment gateway and is instead paid by bank transfer to an account the Company provides. This is a difference in payment method, not a restriction on purchase. Escrow (purchase protection) applies to card and virtual-account payments made through the payment provider and does not apply to such bank transfers; the Company states this at checkout before payment.
Article 10 (Order Changes)
A user may request a cancellation or change before the Company submits the purchase to its overseas supplier. After submission, any statutory right of withdrawal remains governed by Article 13. Supplier ordering alone does not automatically remove that right.
Article 11 (Sourcing and Delivery)
Products may be sourced from domestic or overseas suppliers after an order and delivered after inbound receipt and inspection in Korea. Unless otherwise agreed, inspection covers part number, quantity, visible condition and packaging, not electrical testing or opening a manufacturer seal. Delivery estimates may change because of supplier, international transport or customs circumstances. Domestic delivery charges and conditions are shown before payment. An individually quoted international order may ship directly from a supplier warehouse to the overseas delivery address. This is a fulfilment route; unless the quotation expressly states otherwise, the Company remains the user’s contracting seller.
Article 12 (International Quotes)
A quote request is not a purchase or payment. Individual terms are formed when the user accepts a Company-issued quote within its validity period and the Company confirms acceptance. The quotation specifies eligible destination, freight, Incoterms, duties and import taxes, customs information, return costs and payment method. Its individual terms prevail for that transaction, without limiting applicable mandatory statutory rights. Before international direct fulfilment, the Company may transfer consignee, contact, address and importer information overseas to the supplier and international carrier. Based on the actual contract, it will classify the transfer as overseas processing or third-party disclosure and complete the notice, consent or other procedure required by law.
Article 13 (Withdrawal and Returns)
For a Consumer Transaction, Korean e-commerce law generally permits withdrawal within seven days after receiving the contract information or, if later, the goods or commencement of supply. A change-of-mind return may be restricted where the goods were lost or damaged through the consumer’s fault (excluding packaging opened only to inspect them), materially lost value through use or partial consumption, materially lost resale value over time, or were genuinely made or processed to the customer’s specifications after separate advance notice and written or electronic consent. Ordinary catalog goods do not become custom-made merely because the Company sources them after an order.
For a Business-Purpose Transaction, to the extent excluded from the Korean E-Commerce Consumer Protection Act, cancellation, exchange or return for a user’s part-number or quantity error, project change or other customer-attributable reason is restricted after the Company submits the order to its supplier. If the supplier exceptionally accepts cancellation or return, the Company may offer separate handling based on the actual cost and conditions. A wrong item, shortage, damage, defect or failure to conform remains handled under applicable law and contract. Consumer Transactions retain the statutory three-month/30-day remedy for misdescription or non-conformity. See Cancellations & Returns for the handling process.
Article 14 (Effect of Withdrawal)
The Company refunds payment within three business days after receiving returned goods, or after receiving withdrawal if the goods were not supplied. For card and similar payments, the Company promptly requests cancellation from the payment provider. The consumer pays return shipping for a change-of-mind return, with no separate penalty or damages; the Company pays where goods differ from their description or contract. A reasonable identity or account verification may be required to prevent fraudulent bank refunds.
Article 15 (Defects and Replacement)
For a wrong item, shortage, transit damage or confirmed defect, the Company provides replacement, repair or refund as required by law and contract. Reasonable evidence such as part number, lot, packaging, operating conditions, symptoms and photographs may be requested. Replacement may require return, inspection and a new procurement. If a replacement cannot be supplied, or the user declines a reasonable wait, the Company will refund the applicable amount.
Article 16 (Privacy)
The Company processes personal data under Korean privacy law as described in the Privacy Policy.
Article 17 (Company Obligations)
The Company complies with applicable law, maintains the Store and handles legitimate complaints. Use of suppliers, system operators, payment providers or carriers does not remove the Company’s customer-facing responsibility as seller under applicable law.
Article 18 (User Obligations)
Users must not submit false information, misuse another person’s identity, alter Store information, transmit malicious code, infringe intellectual property, disrupt operations or violate applicable law.
Article 19 (Intellectual Property)
Store content belongs to the Company or its lawful owner. It may not be commercially reproduced, distributed or made available to another party without prior permission.
Article 20 (Disputes and Governing Law)
The Company will give priority to user complaints and, where immediate resolution is not possible, explain the reason and expected schedule. A consumer may seek assistance from the Korea Consumer Agency or the Electronic Commerce Mediation Committee. Korean law governs these Terms and transactions, and jurisdiction follows applicable law.
